The DOL has rejected your 2016 Form 5500 Filing: Now What?

On Tuesday, February 26, NAPEO began hearing from its members that the Department of Labor (DOL) had rejected their Form 5500 filing for 2016. We have now found out that DOL has rejected every 2016 Form 5500 filing that used coding or some other way to mask the participants name in the PEO sponsored benefit plan. Moreover, DOL is giving PEOs 45 days to resubmit the Form 5500 correctly. Failure to do so could subject your PEO to penalties and retroactive fines.

Seth Perretta and Malcolm Slee of The Groom Law Group will be presenting a webinar on Monday, March 4 at 2:00 p.m. to review the Form 5500 filings and the possible steps your company should take. In addition, NAPEO will discuss the steps the association is taking to have the DOL modify its Form 5500 filing requirements to protect the client lists of PEOs.
